GENERAL

    By commissioning the artist (Worgy), you, the client, are agreeing to these Terms of Service. Failure to abide these terms may result in the client being blacklisted from further commissions.
    Terms are subject to change at anytime.
I may sometimes work out of order.
I may take longer than usual sometimes, but that does not mean I have forgotten your commission. (Life happens)
If you do not see your commission on my To-Do List, please contact me to make sure I haven't forgotten.
For TWO characters in one image it will be DOUBLE the price. I do not offer a discount because I do still have to draw two characters.
Art is a job for me, the money I earn from commissions and adoptables alike help me pay for bills and unexpected payments that my funds may not cover. This means that as a source of income, I do not appreciate a client ignoring me or not contacting me to let me know why payment is delayed. If any problems do occur and you haven't paid or can't pay right away, please inform me so I know and can plan accordingly, thank you.
It is the client's responsibility to contact the artist if they cannot pay or if they need / want edits or changes to anything (i.e. payment type, character change).
WHEN YOU ARE CONTACTING ME ABOUT A COMMISSION OR SENDING PAYMENT INFORMATION, YOU MUST TITLE THE NOTE / EMAIL WITH WHAT YOU ARE BUYING AND NOT JUST "PAYPAL" - I sometimes get a lot of commissions, or sales about things and they are just titled "paypal" this causes me to easily lose your information and I have to dig around for it, so PLEASE add your information into the note, thank you.

COMMUNICATION

    All my prices are listed here: Paypal and Points. But if there is not an exact price or you have something else in mind, please contact me via note in these two places:  dA FA 
    When contacting me for a commission, please specify what exactly you want (just saying "I want a commission!" with no refs or information does not help me know if I can accept your commission or not) Please include information such the type of commission you're interested in, your character's reference(s), your username, and your Paypal/email address (This is for if I have to contact you if the website is down, and sending an invoice for payment).
    It is the responsibility of the Artist to maintain contact with the Client to ensure that the commission is completed in a timely manner.* Clients that are unresponsive AFTER I HAVE CONTACTED YOU WITH A WIP or for PAYMENT without notice may have their commission delayed or in some cases, cancelled.
*The exception is when I have made it clear, and stated the commissions will take longer than expected, I will contact you when I have done work on your commission, but you are always welcome to check with me if you want to change something or to confirm I have not forgotten I owe you a commission.
If you commission me to draw your character, and then you trade that character, it is your responsibility to inform me of the trade and tell me if you want the character changed, otherwise I will draw the original character you asked for.

PAYMENT

    I require full payment upfront via Paypal Invoice (USD) or DeviantArt points (by commission widget) only.
    I am being paid for services. The client will not be receiving physical goods.
    Prices are non-negotiable, once I'm given all the details on the commission I will decide the total amount and will note any extra charges (Such as complex designs or an extra character) before sending the invoice.
Fee's are included in the price, I will not be adding on any additional price once the price has been settled upon.
If the client cannot pay for whatever reason after work has been started, the client has 3 days to inform the artist why they cannot pay, and when they might be able to, or accept cancellation.
I have the right to charge an additional price if I see fit to do so, this may happen if; you do not pay in time, do not inform me why you cannot pay, you want more edits after you have approved a sketch and linework has started, if you want more edits after the commission is "complete" unless it is my mistake (i.e. coloured something the wrong colour), ect.

WORK-IN-PROGRESS SHOTS & ALTERATIONS

    All commissions (Unless pixel animations) will get a Work In Progress image to make sure if any edits are need / wanted by the client before it gets finished.
    Once a work-in-progress shot is sent to the client, I will not continue on the commission until I receive a response.
    I will only make reasonable alterations to the commission during the sketch and flat color phase. Any major changes during or afterwards may cost an additional charge depending on the time and effort the change will make. (If you wanted a whole new pose after the initial WIP sketch has been sent to you, an additional charge will be made and I have the right to sell / auction off the unused pose)
    Any mistakes on my behalf (e.g. forgetting a marking on a character) will be corrected without any additional charge.
    After the commission is completed and the client has approved it, I will not make anymore changes to the commission without an additional charge.
    When the commission is finished, I will send both a watermarked version and unwatermarked version. This completes the commission process.
Clients are welcome to join a stream and have their commission done then and there - which saves a lot of time.

REFUNDS & CANCELLATION

    I will not refund complete or nearly completed commissions. 
    Full refunds will only be offered if the commission has not started. If the commission is cancelled before it is completed, the refund will be based on the amount of work that has been done.
    I have the right to cancel and refund the commission for any reason. If the cancellation is initiated by me, the refund amount will be determined on a case-by-case basis.
You have the right to cancel a commission at any time, please explain why and we will discuss refunds if payment has been made.
If you do not inform me you wanted a cancellation and I have completed your commission, you will NOT be getting a refund.

USAGE OF WORK

    The client will not receive a .sai/.psd file of their commission.
    The client is allowed to post the completed commission on any site they wish, but is required to credit me, they must link back to my page on the submission and not claim they drew it themselves.
    I reserve all rights to my artwork and I am allowed to upload the completed commission to any site I wish and use them as examples. I refuse to take down any completed commission work unless I personally choose to unless this has been discussed beforehand and the client does not wish to have their commission uploaded or not linked to them.
    The client retains all rights to their character(s). (If it is a gift for someone, the person it is for retains the rights to their character(s).)
    The client does NOT own the rights to the artwork commissioned and may NOT claim it as their own.
    The commissioned artwork is for personal use only. (Printing it out for a badge, shirt, sticker, ect. for yourself is allowed) The client may NOT use the artwork commercially or resell it.
    The client is not allowed to edit the artwork without permission, unless it is to use as a decoration for their webpage, cropped for an icon, re-sized, ect.

DESIGN COMMISSIONS, ADOPTABLES, & DESIGN AUCTIONS

    Credit is only required at least one time.
    Once a design is purchased, the client is free to change minor details (markings, colors, name, ect.) as long as the design is not changed beyond recognition.
    Reselling the design is allowed, but no higher than what the design was originally purchased for. (Unless you made or paid for additional art to be of said character _{Password: Cupcakes} )
    Adoptables/Auctions will only be held for 48 hours prior to the initial transaction.
    The design is for personal use only. The client may NOT use the design commercially.
If a design is made of a Closed Species, you must keep it as the species. Unless discussed prior.
If you trade / sell the design you got from me that is a CLOSED SPECIES, you MUST inform me of the new owner.
If you have commissioned me to make a custom design and do not get back or me, or do not pay me when I have started work on it, I have the right to resell / auction the design off if I do not hear from you within 3 days.

SUBJECT MATTER (WHAT I WILL / WILL NOT DRAW)

    The commission will almost always be declined if the character/subject is on the "Will not draw" list below. I rarely make exceptions.
    Commissions that greatly differ from my usual work may be turned down or cost an additional charge.
    I have the right to decline any commission I may not be comfortable drawing and I am not required to provide a reason.
    Declining a commission due to the subject matter does not mean the client is blacklisted, they are free to change the character/subject of the commission. However, if you try to argue in an attempt to change my mind, you WILL be blacklisted.
    If you are unsure about any of these subjects, or about one that isn't listed, feel free to ask me!

I WILL DRAW

Anthropomorphic animals (Furries) - I am willing to do most species; cats, dogs, dragons, ect, and I always want to try ones I haven't drawn before!
Feral animals (Quads) - (Same as above.)
Monsters (Anthros / Quads / Both) - I love adding a creep factor to anything I can, so monsters are always an adventure with me
Copyrighted material / characters* - I will draw characters / species from a show / game (e.g. Pokémon, Digimon, My Little Pony, ect), your FanOC's
Transgender and Intersex characters - As long as they are depicted in a respectful way.
Any gender
Gore

    

I MAY DRAW

Situations - I usually draw just simple poses and character expression, but if you wanted characters in a certain setting or with a background, you must discuss with me.
Weapons / Armor - I may draw guns and I may be willing to draw armor and weapons like Swords, Hammers, ect. if they are not too complex. This will cost an additional charge.
Backgrounds - The complexity of your request and how long it takes me to understand it (e.g firey backgrounds) will determine the price of it
Humans, humanoid characters and primates

I WILL NOT DRAW

Fat characters (Unless it is a species like Cinnadogs)
Overly muscled characters
Transformation
Fetishes
Pornography
Hateful themes: I will not draw characters/subject that I feel are offensive. (Transphobic, Homophobic, Racist, ect.)
    Copyrighted material / characters* - I will not draw "Fan characters" that are extremely similar to copyrighted ones.

*If you have any questions about the 'Copyrighted characters' section, and are unsure if I will accept your commission or not, please contact me first before asking to get a commission.

If you wish to have a more detailed drawing, please let me know how detailed you'd like it (Only exceptions are chibi and icons).
